11.4.2 Preparation and institutions of land consolidation measure

11.4.2.1 It is the tasks of land consolidations to improve production and working conditions in agriculture and forestry such as to ensure environmentally sound and optimal natural resource management. The bodies responsible for Implementing or administering this task require not only legal mandate, but al so preliminary plans which set priorities, and harmonize activities, capacities, financing and deadlines.

Work plans set forth program directives for periods of 2-5 years (primary and secondary priority of institution and implementation) The work plans also serve as a source of information for the cooperating administrations and other planning bodies, as well as the affected persons and groups.

11.4.2.2 - The immediate preparation of a land consolidation project involves
- drawing up the list of objectives and activities
- delimiting the area for consolidation
- informing and consulting with other public institutions
- identifying particular problems which may arise

11.4.2.3 From the technical point of view cadastral and topographic maps are required. Cadastral maps must shoe the boundaries of ownership and/or land-use rights, marked accordingly (plot numbers), and show land-use systems, as well as buildings and other structures. Topographic data are very useful. Depending on intended further use of the maps, the recommended scale is 1 : 2000 - 1 : 2500, although 1 : 1500 - 1 : 5000 is also considered appropriate.

Topographic maps are required on a scale of 1 : 5000 to 1 : 10000, as well as 1 : 25000 for information purposes. For topographical varied terrain, contour lines are absolutely essential. Orhophotos on a scale of 1 : 2000 or 1 : 2500 have also proved a useful supplement.

Most important is that the maps used are up to date.

11.4.2.4 Procedural formalities

Prior to the actual decision to launch the project, the authorities and organizations which are expected to be affected by the measure are invited two weeks before to a meeting, at which the project is presented and all matters affecting the project area are discussed.

Similarly, all affected landowners and land users are invited to a meeting, at which they are to be provided with information on the aims, boundaries, costs and land recovery for agricultural infrastructure.

Subsequent to that, the documents for institution of the measure are drawn up. These are: map of the area, cost estimate and financing plan, explanatory report covering the results of the preliminary investigations.

11.4.2.5 Official institution of the land consolidation measure

On the basis of these documents, the measure is officially instituted by the responsible authority.

This issue of the legal act establishes the right to implement the measure, and the obligation of affect persons and groups to take part. The legal act is publicly announced. As of the act coming into force, the community of participant automatically comes into being as a corporation under public law (objections may be raised).
